Terms & Conditions of Sale

The Cocoa Tree Shop Limited is trading as The Pittenweem Chocolate Co.
All payment transactions will be processed by and listed as “The Cocoa Tree Shop Limited”.

Allergies -  all our chocolates & products may contain traces of milk & nuts.

Weights Packed – the weights & number of chocolates shown are approximate. The hand made nature of our chocolate selections shown are sold as near as possible to the weights indicated.

Selection Content & Availability – content of our selection boxes & sachets are subject to availability of specific chocolates and may vary (especially for fresh chocolates).

We try to maintain stock of all our regular chocolates and stock items. Sometimes, due to high demand and the handmade and fresh nature of our products, certain stock listed on the Pittenweem Chocolate Company web site may not be available immediately. We will endeavour to contact you and dispatch these items as soon as feasibly possible, or will arrange for a similar stock item to be included with your order.

VAT – all prices include VAT at the applicable rate (currently 20% – Jan 2011).

Postage and Packaging charges are shown at time of order confirmation & include packaging and postage charges. The fragile nature of the product determines the need for appropriate packaging. Despatch is normally with 24 hours of order (this may vary at certain times of the year – but orders will be dispatched as quickly as possible. Delivery is made using Royal Mail standard parcel service or “next day by 1-00pm signed for delivery” with Royal Mail, as selected by you. We reserve the right to change delivery mechanism to best suit the destination and the goods being shipped (especially if weather temperatures are high).

If using the “next day by 1-00pm signed for delivery” with Royal Mail, please ensure someone is at the delivery address to receive the consignment. We currently only ship to the mainland UK from the website. Please contact us directly for shipping to other countries and regions.

The Pittenweem Chocolate Company is not responsible for non-delivery due to circumstances beyond our control or issues with postal delivery services, weather conditions etc.. Proof of postage can be provided as required.

Refund Policy – You have the right to cancel your order within seven days of purchase , or seven days of receipt of the goods (whichever is the longer). If you cancel the order, you will have your payment returned on receipt of the returned goods. Goods supplied must be returned immediately, unopened and in the same condition they were received. You will be responsible for shipping and postage costs for the returned items and for damaged or poorly packaged returns.

Returns & Damages – we can only accept returns or claims for damage where products are received damaged or poor condition through circumstances within our control and which have been notified to us immediately on receipt. We cannot accept liability for damage received to products shipped where they have been damaged or delayed in circumstances out with our control.

All packaging provided for delivery is adequate to protect the products in normal postage and delivery circumstances (as detailed above). Our chocolates are fresh and we are unable to accept liability for extremes of temperature or delays during shipping that are outside of our control and that may affect the quality and /or appearance of the chocolates.
